i was wondering where the scratches on the swing arm came from. can somone tell me what it is and how to mak it not just hang there and scratch everything.

That loose piece is a holder for the brake hose, it's bolted to the top side off the swing arm.

thats what i figured. there is one spot that it could be bolted down to, but there is a tab on the side that prevents it from fitting in the right spot. maybe at the last brake service it was replaced backwards because it looks like it would fit if it were turned around on the brake line.
should i just cut it off or ziptie it out of the way? i dont think it can be bolted down i its place now.
Just have someone hold the brake lever down while you undo the line. That way you can flip it around to the proper orientation. reinstall the brake line, bleed, and bolt the brake line guide down. It'll probably take half an hour.

You can do that, you can also use duct tape ;D

Best to mount it like darkmatter said.
