01 SV650 with hyosung engine?

I bought an sv650 with the description mint, nothing wrong, practically new... I got it and it had a sticker over the engine cover where when i peel it off it says Hyosung.. the engine clearly doesn't fit right there are engine mounts missing and lines coming off of the head that are plugged (under exhaust outlet), assuming they are oil feeds? He says he installed the new motor aprox 800 miles ago, i just assumed it was the right one... It seems to ride up down the driveway just fine. What am I getting into here? Is it even worth $2k It is nice otherwise but is this a deal breaker or can i rig mounts and be on my merry way? Any experience with the hyosung engine?

To those who care and didn't look it up, here is the description from the Ebay ad. All the pictures were like Myspace photos for bikes, so I didn't include them.

Highlighted the normal red flags too... To the OP: I'm sorry your first foray into sport bikes has gone so horribly, horribly wrong. BTW, state and federal lemon laws are almost always exclusive to only repairs made under the manufacturer's warranty. IE, if some numbskull wanted to do an engine swap and sell something, you can't cite him under the lemon law. You can, however, ruin him through PayPal, ebay, and small claims court as you see fit.

It comes down to reasonable reliance. If it was reasonable for the OP to think this bike had a Suzuki engine, then the fraud is actionable. Given the seller's assurance of "no damage," the claim of a "new engine" reasonably implying a new Suzuki engine, and the strong resemblance of the Hyosung engine to the SV's engine, I'd say the OP has a pretty good case.

I'd like to see the seller argue that yes, he pulled a fast one, but the OP can't recover because he should have seen through the fraud. That's a crappy defense, IMO.

D*mn man. That sucks bad. But did you not notice the mounts that were cut or broken? I understand the sticker part, but even at a quick glance you can see that something isn't right. Sorry to hear about that.

Any insurance company would probably total the bike because of this. I've seen bikes totaled because of much less frame damage than that. Hope you don't have too much trouble getting out of it. And +1 to not buying a pig in a poke.

for the love of god whatever you do, DO NOT RIDE THAT THING. Thats number 1, those mounts could fail at any time, please dont endanger your life because you feel you are stuck with it.

Even if small claims court does cost money to file the suit, i would do it just to drag his ass through court. Frame is a write off and motor isn't worth anything. Thats bad dude, and definitely make sure you take someone who knows bikes or is at least mechanically inclined with you next time. Thats just bad. :(

Guy will be giving me my $700 back since I have bike and he'll want to try and sell it to someone else...
I am mechanically inclined problem was I already made a hefty downpayment and actually believed that the motor was done professionally and even thought of making brackets to secure the mounts... Interesting first experience buying a used motorcycle! Man that coulda been a nice bike, anyone got a 1st gen sv650 for sale? Must have engine bolted to all mounts!;D

No, it isn't worth it in parts right now. Get ALL your money back as soon as possible. Some diligent member on here will then inform us of future dealings this guy tries to have.

Seriously, don't even consider keeping any portion of this bike unless he gives you the whole thing for free.

Even if you get all of your money back, ebay should be contacted and feedback left for the sale that item was not as described, mint means the frame is not junk and unsafe.

"ruining him" is way more effort then its worth, the bike is worth what he's asking in parts, forks, wheels, radiator the hyosung motor if it works would probably sell for a few hundy on e-bay, swing arm, seat, rearsets etc, but he should be selling it as so...
